The same as they would be split in a heterosexual divorce pursuant to Chapter 61. What we would do is evaluate whether or not the assets at issue were premarital, postmarital, if they were purchased with contributions to the marriage such as either spouse’s income. Once we separate out each spouse’s non-marital asset, then we divide the marital assets pursuant to the statute.
